Customer Consent Form
1. Introduction
1.1. The Protection of Personal Information Act 4 of 2013 (“POPI”) came into full effect on 1 July 2021. The purpose of POPI includes inter alia, giving effect to the right to privacy, regulating the way in which personal information must be processed and providing rights and remedies in circumstances where the provisions of POPI are contravened. In view of the promulgation of POPI the Company requires the written consent of customers in order to collect, process and distribute their personal information in terms of POPI.
1.2. Personal information includes but is not limited to a customer’s name, identity number, address and contact details, email address, financial information such as VAT certificate, annual financial statements, management accounts and/or any other Personal Information required in order to conclude the agreement.
1.3. In accordance with the provisions of POPI, the Company will implement appropriate and reasonable security safeguards in order to ensure the integrity and confidentiality of personal information in its possession and/or under its control.
2. Personal Information/ Special Personal Information
2.1. The Company processes personal information/special personal information as defined in POPI in accordance with the provisions of both POPI and its POPI Policy.
2.2. The Company will collect and process personal information and the special personal information of a customer for inter alia the following specific purposes:-
2.2.1. preventing and curbing the spread of covid-19;
2.2.2. for legitimate business purposes, including providing a service and/or goods to the customer; and
2.2.3. marketing purposes;
2.2.4. to consider the customer’s application for credit facilities;
2.2.5. to conclude and/or enforce any agreements with the customer;
2.2.6. to establish a data base of vetted purchasers;
2.2.7. complying with any laws that may be relevant to the business relationship.
2.3. In view of the aforementioned the Customer hereby expressly consent to:-
2.3.1. the processing of his/her personal information/special personal information as defined in POPI by the Company, any affiliate or subsidiary company and/or any third parties including the 2 Company’s agent/contractors authorised by the Company to process the personal information; and
2.3.2. the transfer of the personal information/special personal information to any affiliate or subsidiary company of the Company outside of the Republic of South Africa for the specific purposes for which it was collected as set out above. In this regard the Company will only transfer personal information outside of the Republic of South Africa or transborder information flow in accordance with the provisions of POPI.
2.4. The personal information/special personal information will be stored by the Company in accordance with its POPI Policy, which is available upon request.
